Firearms and Bows - Use and Transportation Safety

Wisconsin and the Greater Brillion Area is blessed with good weather and conditions for hunting. However, taking advantage of the opportunity for hunting, comes with responsibilities for the safety of others. This ordinance is paraphrased and is only a highlight. First, some definitions:

Encased means enclosed in a case that is expressly made for the purpose of containing a firearm and that is completely zipped, snapped, buckled, tied or otherwise fastened with no part of the firearm exposed.

Firearm means a weapon that acts by force of gunpowder.

Unload means any of the following:

(1) Having no shell or cartridge in the chamber of a firearm or in the magazine attached to a firearm.

(2) In the case of a caplock muzzle-loading firearm, having the cap removed.

(3) In the case of a flintlock muzzle-loading firearm, having the flashpan cleaned of powder.

Prohibitions - motorboats and vehicles; highways and roadways.

No person may place, possess or transport a firearm, bow or crossbow in or on a motorboat with the motor running, unless the firearm is unloaded or unless the bow or crossbow is unstrung or is enclosed in a carrying case.

No person may place, possess or transport a firearm, bow or crossbow in or on a vehicle, unless the firearm is unloaded or unless the bow or crossbow is unstrung or is enclosed in a carrying case.

No person may load or discharge a firearm or shoot a bolt or an arrow from a bow or crossbow in or from a vehicle.

No person may load or discharge a firearm or shoot a bolt or an arrow from a bow of crossbow from or across a highway or within 50 feet from the center of a road.

Exceptions:
The prohibitions above, do not apply to any authorized persons who, in the line of duty, place, possess, transport, load or discharge a firearm in, on or from a vehicle, motorboat or aircraft or discharge a firearm in, on or from a vehicle, motorboat or aircraft.

Winter Parking

The City of Brillion winter parking ban is in effect from November 15, 2003 thru April 1, 2004. There is no parking on City streets without prior permission from our department between the hours of 1AM and 6AM.

Overnight parking permission, can be obtained by calling our department and providing your vehicle information and location. Persons requesting to park overnight on any City street during the winter parking ban hours will have to call in on a daily basis to be granted permission.

Recreational Fire Pits

Ordinances related to recreational fires:

Sec. 34-97. Recreational Fires.

All recreational fires shall comply with the following requirements (listed in part).

  • No permanent or portable fire pit shall be closer than 20 feet from any building, structure, shed, or garage. No recreational fire shall be built larger than three feet by three feet.
  • Any permanent fire pit shall be built in a below ground pit surrounded on the outside by a non-combustible material such as concrete block, metal or rocks with a minimum depth of ten inches and shall be covered when not in use.
  • All recreational fires shall be extinguished and in ground pits shall be covered when not in use.
  • No recreational fire shall be started unless there are favorable conditions for burning with regard to wind direction and speed.
  • Adequate fire suppression equipment shall be immediately available to control or extinguish the fire.
  • Any person wishing to have a fire pit must, prior to any construction of a fire pit, obtain a permit from the City Clerk.
  • Any person requesting a permit must file a document with the City Clerk containing the signatures of all adjoining property owners, indicating that the adjoining residents have no objections to the issuance of the permit or the use of a fire pit on the applicant's property. The permit must be renewed every five (5) years.
  • The registration an renewal fee is $15.00.
  • Recreational fires may be started and allowed to burn between the hours of 4:00PM and 12:00AM on weekdays Sunday through Thursday, and between the hours of 4:00PM and 1:00AM on weekends Fridays and Saturdays.
  • All fires shall be attended to at all times by at least one responsible person over the age of 18.
  • The Fire Chief may post "No Burn" conditions, during which times no burning whatsoever will be allowed.

Bicycle Licenses

All bicycles or any similar wheeled vehicle customarily kept within the City must be registered by the owner and properly licensed. Applications for registration can be obtained at the Brillion Police Department, and require a one-time fee of $3.00.

Curfew

The City enforces a curfew for residents less than 18 years of age. No child shall loiter, idle or remain on any public place between 10:00PM Sundays, Mondays, Tuesdays, Wednesdays, or Thursdays and 6:00 AM the next day, and between 12:01 AM and 6:00 AM on Saturdays and Sundays unless accompanied by his parent, guardian or other adult person having legal custody of such child or such child is in lawful employment making it necessary to be in such place after the time stated.

Noise - Excessive Noise

Be considerate of your neighbors when operating any audible device, whether it be machinery or musical instruments. Operating such devices between 11:00 p.m. and 7:00 a.m. in such a manner as to be plainly audible to your neighbors may be in violation.

Snow and Ice Removal, Sidewalk Maintenance

All property owners or occupants of a lot abutting a sidewalk are required to remove all snow and ice from sidewalks within 24 hours after a snowfall or sleet storm. Please do not plow or shovel snow into the streets.

Snowmobiling
Snowmobiles are allowed to operate in Brillion, and prhibited in the following areas:
  • snowmobileUSH 10/East and West Ryan Street in its entirety
  • CTHPP/North and South Main Street, from USH 10 south to Horn Street.
  • On any City sidewalks
  • Within the boundaries of any City park or cemetery
  • Upon any private property, without previous consent/permission of the owner.

Speed Limit - Not to exceed 15 MPH at all times

Equipment Restrictions - Mufflers must be original equipment without modifications.

Lights are required to be operating at all times, day or night

Position on the Roadway - on the right most side of the roadway as physically possible, and in the same direction as regular vehicular traffic on the same roadway.

Solicitors

Solicitors are required to register at City Hall to obtain a permit.

School and Safety Zones

School and Safety Zone restrictions are strictly enforced by the Brillion Police Department, especially to ensure the safety of our children. Please adhere to these guidelines as provided by the City of Brillion Municipal Code.

Speed, Parking Signs (City of Brillion Municipal Code)

In accordance with Wis. Stats. § 118.105, the following applies to all the property of the Brillion School District or private schools, whether owned or leased, within the city:

(1) Speed limits. The speed limit on school premises where motor vehicle traffic is permitted is 15 miles per hour. Operating a motor vehicle on school property in excess of 15 miles per hour is prohibited.

(2) Parking restrictions. The posting of no parking signs on school property is dictated by the board of education, and parking is prohibited where those signs are posted.

(3) Obedience to signs. Where posted, no person shall operate a motor vehicle where specifically prohibited by sign.

Pedestrian Safety Zones (City of Brillion Municipal Code)

Pedestrian safety zones are established as follows:

(1) In the center of the block on Francis Street between Oak Street and Park Avenue from the Brillion Iron Works employee entrance to the parking lot, being approximately 135 feet from the corner of Park Avenue and Francis Street.

(2) In the center of the block on Center Street between Main and Columbus Street from the Community Center Building to the parking lot approximately 240 feet from the corner of Main and Center Street.

(3) West Water Street between Custer Street and Elm Street from the entrance to Trinity Evangelical Lutheran Church to the entrance to the Trinity Evangelical Lutheran School.
